Robert Swanzy and John W. Swansey

As I request with all my work, please do not copy and paste or use this information unless you link back to this page and/or cite me as the researcher. It takes hundreds of hours to put together information like this, and it would be nice to be appreciated. Also, when people have questions about the info, they know where to go for the source. You will notice that I link back to the pages when I refer to other people’s work. It’s just an integrity thing.

This name is spelled Swanzy, Swansy, Swancy, Swansey, Swancey depending on the document.  My own belief is that the origin of the name was Swansea, although I’m not sure I understand the etymology of that.  The following information is a collection of transcriptions of Equity Court records and probates that are relevant to the family as it was at the turn of the century (1800) in Abbeville, South Carolina. I come at it through the Walter Anderson family who were close neighbors and friends, and who intermarried with the Swancey family.

Lucy, wid of John Wilson Swanzy dec.1804 T in NC on a trip. 2 sons: Robert, John W (unborn at his death). G.W. Hodges, gdn of two boys. This is a complaint that these two boys should have part in their grandfather’s estate by claim of their father. It is quite long and convoluted: Robert Swanzy (Swancy, Swanzey, etc), in 1774 had been possessed of 130 acres on the Saluda and a valulable ferry called Swancey’s Ferry. Wanted to move to Virginia and agreed with Sylvann? Wacker (a liar) to swap properties for land in Greenbrier Co VA. Got there and found no such land. Stayed a year, and was going to move back, but he died, Testate. His widow, Rosanna, with John, went back to SC, won back their property then returned to VA for the rest of the fam.

Samuel Swanzy (who would become Dr. Samuel S.) and Samuel Nesbitt appt execs. Rosannah bought 200 acres then dec i. Ferry was sold to Dabney Puckett – who didn’t pay. Then Mr. Pinson. James Swancy, another brother in Spartanburgh. Samuel dec i a few years ago in AL. James administrator. Harrison Long the AL admin. Lucy’s John dec 1804 T. Box 60/3271  Of the Equity Court of Abbeville, South Carolina.

Transcription:  Humbly complaining shew unto your honor your orators, Lucy PULLIAM, late widow and relict of John Swancy decd and Robert Swancy and John W. Swancy, children heirs of the said John Swancey (Which said Robert and John W, being minors, sue by George W. Hodges, their guardian, that Robert Swancy, the father of the said John Swancy and grandfather of your orators, Robert and John W.

Sometime about the year seventeen hundred seventy four, being seized and possessed of a tract of land containing about one hundred and thirty acres situate on Saluda River in the district of Abbeville on which there was and is a valuable ferry known by the name of Swancy’s Ferry, and being desirous to remove to the state of Virginia agreed with a certain Sylvanus (?) Wacker to exchange with him the said tract of land for lands which the said Sylvanis Wacker pretended he owned in Greenebrier County, Virginia. In consequence of this agreement, the said Robert Swancy about this time before mentioned removed with his family to the said county of Greenbrier in Virginia where he was unable to find any such land of the said Sylvanus Wacker. He had represented himself to possess.  Not being able to return to South Carolina immediately, he remained there for nearly a year when he died. A short time previous to his death the said Robert Swancy duly made and executed his last will and testament by which he made a disposition of his estate, a true copy whereof is herewith filed  and marked Exhibit A which your Orators pray may be taken as art of their ? and referred to as often as neccy.?.

Soon after the death of the said Robert Swancy, his widow Rosannah Swancy and his son John Swancy returned to South Carolina  and there succeeded in getting back the ferry and land on Saluda River thus rescinding the contract formerly made with the aforesaid Sylvanus Wacker. They then returned to Virginia and moved back the family to South Carolina.

Rosanna Swancy, the widow, Samuel Swancy one of the ? sons, and Samuuel Nesbitt were appointed executors  of the said will and after the return of the family to South Carolina, the widow and the said Samuel Swancy qualified as execs  and took upon themselves the further? Execution of the said will.  Not long after their return to SC, the execs made a sale of the estate of which the widow became the purchaser of nearly the whole of the property ?. A copy of the said sale? Bill? Is herewith exhibited and marked B.

Your orators further show unto your honor that the personal property of Robert Swancy was appraised to the sum of two hundred and ninety one pounds, nineteen shilling, equal to twelve hundred fifty one dollars, twenty one cents. Some time after the family had again settled in South Carolina, Rosannah, the widow of the said Robert Swancy, purchased a tract of land in Abbeville District containing about two hundred acres.  Your orators further show unto your honor that sometime after this purchase the said Rosanna Swancy departed this life as your orators believe intestate. None of the negros of the estate of Robert Swancy having been sold by his executors, they with a large proportion of his other personal estate remained in the possession of his widow until her death.

After her death, Samuel Swancy the surviving qualified exec of Robert Swancy took the whole of the estate both of Robert Swancy or as exec or a administrator of Rosannah Swancy in unknown to your orators and had the same sold at public auction. At the sale, he became the purchaser of all the negros and the next day had them appraised for division amongst the heirs. Being divided into equal lots, they were drawn for  by all the heirs except your orators, the heirs of John Swancy (who before this time had departed this life) to whom money in lieu of their share of the negroes, was promised.

The said Samuel Swancy then offered at public sale the land and ferry which being bid off by a certain Dabney Plechet? (marked over) who failed to comply with the terms of the sale they were rented for one year at the price of two hundred dollars or upwards. The said Samuel Swancy afterwards sold the said land and ferry to a Mr. Prison? Pinson? For the sum of three thousand five hundred dollars.  Your orators further shew unto your honor that Samuel Swancy and James Swancy, his brother, now residing in Spartanburgh District received the whole of the proceeds of the sale of the land and ferry. Your orators further shew unto your honor that a few years ago Samuel Swancy departed this life intestate in the state of Alabama and that his brother, the aforesaid James Swancy administered on his effect? In Abbeville? Distric. Harrison Long now a resident of the district administered his effects in Alabama.

John Swancy, the former husband of your oratrix Lucy Pulliam and father of your orators, Robert and Jno W. some time about the year 1804 departed this life having first duly made and executed his last will and testament by which he devised? his estate to your orators as by the said will more particularly appears a true copy whereof is herewith exhibited and marked C. The testator in this will named your Oratrix Lucy Pulliam and his brother the aforesaid Samuel Swancy and Samuel  Av? His execs the two last of whom qualified thereon took upon themselves, the brother of the exec thereof and disposed of all the effects of the testator. This appraisment, account of sale, the cash In hand at testator’s death and debts ? the estate will appear by reference to exhibit DE +?A herewith  ? of this Bill.

Your oratrix Lucy acknowledges the receipt of her part of .  . . husband of the late John Swancy’s estate but has never rec’d any part of the estate of Robert Swancy and Rosanna Swancy and your orators Robert and John W. Swancy have not received their shares of either of the said last mentioned estates or of that of their father the said John Swancy. Your orators further shew unto your honor that they have frequently called upon the said Samuel Swancy in his life time ? said James Swancy and Harisson Long  ? his death to pay over to them their proportion of the estates of their grandfather, Robert Swancy and o their grandmother  Rosanna Swancy. I have also frequently called upon the said Samuel Swancy , and Samuel Anderson during the lifetime of the former the said James Swancy and Harrison Long and Samuel Anderson since the death of the said Samuel Swancy for a friendly settlement and account of the estate of their father the said John W. Swancy. But now so it is the said James Swancy and Harrison Long and Samuel Anderson  have refused to settle with your orator, pretending that nothing is due to them and making other ? ?. To the end therefore that the said James Swancy, Harrison Long and Samuel Anderson may on their several  –

[The end is a request for a writ of subpoena to force an accounting.  At the bottom of the page it says: And the complaintents in the foregoing bill amend their bill and charge Wilson Crane And (blank) his wife of the district of Edgefield, Wm Turner and (blank) his wife and Wm Weir, Guardian, in the same terms as the said gentlemen have intermarried  with two of the distributes of the estate of the aforesaid Saml Swanzy and. Wm Weir is guardian for (no names) who were distributees.]

Pg. 4:  is a spine. The case is dated 1821. Names the above named main players. 26 Nov 1821.  The amendment seems to indicate that the papers were served on the new defendants in 1824. A nasty biz, suing family.

Pg 5: The separate Answer of William Wier, gdn of Robert Swanzy, Eliza C Swanzy, Mary Swanzy and Louisa Swanzy, minor children of Dr. Samuel Swanzy dec to the bill of complaint of Lucy Pulliam.

The defendant reserving to himself of all manner of exceptions to answer to so much of said bill. As he is advised it is material that he should answer, answering saith: that this defendant was appointed gdn of Sarah Ann Swanzy, Robert Swanzy, Rosannah Swanzy, Eliza C. Swanzy, Mary Swanzy and Louisa Swanzy minor children of Dr. Samuel Swanzy by order of the court of Equity at Feb term 1821. This his ward Sarah Ann Swanzy and Rosanna Swanzy have since intermarried with William Turner and Wilson Crane. This defendant further states that having attained letters of gndshp long subsequent to the date of the transactions recited in complaintant’s bill, if any such ever took place, he is wholly ignorant thereof and it regards the justice of the claim now set up against the estate of Dr. Samuel Swanzy he will willingly submit to any order or decree which to this Honorable Court may seem meet.

Goes on to say that he received by virtue of his gdnshp 3255 or thereabouts of which amount $580 in notes.  Of this amount however, this defendant received on thousand forty one dollars from the estate of John R Long, dec, the father of Lucy Swanzy, the mother of defendant wards who ? their deceased mother in a distribution of said estate and which cannot be held liable for the payment  of any claims set up against the estate of Dr. Saml Swanzy dec.  – more verbiage. But this is the long and short of it.

Pg 6: The answer of James Swanzy admin of Samuel Swanzy  ( I am not going to transcribe it word for word. James admits the truth of the Bill of complaint as far as the death and history of Robert Swancy and john W. Swancy are concerned, but as far as any claim the complaintent is making, he denies that there is ANY right whatsoever, inasmuch as the will of Robert Swanzy leaves John W. no money outside of the finishing of his education, which was done. As to the assumed intestate estate of Rosannah, her  estate was distributed by Samuel Swanzy among the legatees of Roger Swanzy agreeable to the spirit and tenor of the LW T of R. Swanzy. Though Rosannah purchased the bulk of the estate of her husband, it was in trust for her minor children. As it is, James remembers seeing that John W received $900 from his mother as his distribution, which was a larger share than anyone else.  And there were 9 legatees.

In regard to the estate of John W, the defendant admits the submitted will, but  – okay, not quite clear on this, Samuel Anderson, co-exec, received some seven hundred dollars, the balance of the John W. estate. But then goes on to discuss Samuel Swancy, who evidently died intestate and it gets complicated here.

Pg 8 – the separate answer of Samuel Anderson (oh, how I wish they’d had typewriters).  He admits (with total exception) that John Swanzy died in the indicated time frame, having first made his will., and that Samuel was named one of the execs. And that the docs submitted as exhibits DEF contain a true account of appraisal and sales, cash on hand and debts.  Sam qualified as exe but never engaged in the affairs of the estate , but did as exec and took over management and control of the estate.  He says that John Swanzy died in Northhampton County, NC and that Samuel himself and Samuel Swanzy went after his body or property? And brought it out to Abbvelle district.  This respondent borrowed money to pay the expense of the trip. And Samuel Swanzy paid him twenty eight dollars to cover those expenses. – also leant Sam’l some cash. The handwriting, (thank you Noble Wardlaw) is not fun to read.  Anyway, he seems to be proving his clean accounts.

Pg 9 – what follows are sheets of accounting from these various estates. I cannot discern which estate goes with which list. But here are the sales names:

Pg 10: left – more sales including (not repeating names) Lucy Swanzy, widow.  AH, THEN THIS IS JOHN’S SALE. Also James Hodges, Samuel Anderson.  So this was a small, family and friends group.

Pg 10: right, the text of the will of John Wilson Swanzy:

First paragraph the usual acknowledgement of mortality and willingness to abide by the will of the Heavenly Father.

I wish all my real and personal Estate to be sold to the highest bidder twelve months verdit and to be equally divided between my Wife Lucy Swancy and my son Robert Swancy, provided my Wife be pregnant, it is my desire that the child she is pregnant with shall share an equal proportion with my Wife Lucy Swancy and son Robert. I appoint and nominate Lucy Swancy, Samuel Swancy and Samuel Anderson as Execs to this my LW and T.

[Then his assurances that this is actually the legal and last will, revoking all others.

His signature looks just like John M. Swancy, as it had appeared in another doc. But it is actually John W. as it appears in most other places.]

6th day of March, Northampton County, North Carolina.

In the name of God Amen, I Robert Swanzy as being weak of body but of a perfect mind and memory, thanks be to the giver of every Mercy but calling to mind that it is appointed for all mankind once to die for several considerations moving me thereto  I make this my last will and testament in manner and form following:

First I ? surrender my soul to Almighty God who gave it to me. My body, I recommend to the Earth to be buried in a decent manner. The ? of my Executors to be afterwards appointed hoping it at the resurrection God by his goodness will unite both and bring me to a happy Union.  And as to what Worldly substance God in the course of his providence has been please to   me with  I ? and bequeath it among my wife and children in form and manner following. that is? ? I give and bequeath to my beloved daughter Jenn at the settling of the affairs of my estate forty pounds Sterling exclusive of what she has already received – I allow what money may be necessary to finish the education of my two sons, John and Samuel after this is done from the whole of my estate I allow I wish my family to remain together until this Crop is finished and have the blessings in this part of the World sett? I also wish the household furniture to remain in possession of my dear Wife and as my daughters marry, they shall have their beds that they now claim and their clothes and after the crop is made then I order all my effects to be sold to the best advantage except on Negra fellow named Phillop, two negro wenches named Rhoda and Rachel one child named Milly. They are to work for my wife and young children till they come of age and when they come of age  ? negroes are to be sold and the money divided among my children at the discretion of my dear Wife if she remain A widow. If not at the discretion of my Execs. And with regard to what else I am possessed of I allow after it is sold and made into money to be divided among my wife and children equally except my two sons John and Samuel whose shares? Is to be as above mentioned. I do now constitute and appoint my dear wife Rosannah Swanzy and my son Samuel Swanzy and my friend Samuel Nesbett to be my Exec to this my LW and T Hereby revoking and disannulling all other Will or wills publishing and declaring this to be my last will.  Signed, sealed and published and delivered to be my LW in present of us this twentieth day of June in the year of our Lord one thousand seven hundred and ninety five.  Signed Robert Swanzy LS

State of South Carolina. This will was produced and certified in SC by Moses Taggart in what reads as the thirteenth day of June  one thousand seven hundred and ninety six. I am assuming that six is the right number as the appraisal of the estate took place one month later.  Appraisal done by Alex Sample, Walter Anderson and Nathan Sims.

Elizabeth Pulliam: I am acquainted with the parties. I heard Mary Anderson at the house of Bej. Pulliam in the presence of her husband, Saml Anderson, tell Lucy Pulliam that she would take the two boys, Roger and John  school board and clothe them for the interest of their money.

Cross examination: At the house of Benjamin Pulliam, a short time before he died, no one in company but Samuel Anderson and his wife as I recollect. Mary Anderson Addressed herself to Lucy Pulliam.

Pg. 17:  1823 deposition of John Pulliam: I never heard Sameul Anderson say whether or not he had any money belonging to the Estate of John Swansey to the best of my knowledge. As to the amount, I never understood, but I heard Mrs Anderson, the wife of Samuel Anderson tell Ms. Pulliam, formerly the wife of John Swansey dec. in the presence of her husband that she would take her two boys, Robt and Jon  and school and board and clothe them for the interest of their money, which I understood was in Samuel Anderson’s hands as an Exec of John Swansey. Lucy Pulliam replied and said if any person sets the interest of their money why main’t I.

Aug 3rd: I was present at the division of negros and called on as one of the appraisers to value them. By Samuel Swancy. And at the same time heard Saml Swansey tell Lucy the widow of John Swansey dec the reasons why he did not give her a draw in the negroes. His reasons were that if she drew a negro that it would be obliged to be sold to make a division among them (that is the heirs of John Swansey) that he woud pay them their part in money. As to the amount of the dividend I know not.

Cross exam: As to the time I do not remember but it was in the lifetime of Dr. Saml Swansey, the proposal was made by Mary Anderson to Lucy Pulliam in the presence of her husband Samuel Anderson, at the house of Benj Pulliam, in time of his absence in the army – to school, board and clothe the tow boys mentioned for the interest of their money. I understood in the hands of Samuel Anderson. As to the negro Phil, I know nothing about what ? passed.

Seeking information on Robert Swanzy (b) ca 1740 Phil. PA;(d) 22 June 1795 in Greenbriar Co., West VA. He was the son of Samuel and Jean Swanzy of West Pensborough, Cumberland Co., PA. Robert married Rosannah Pinson. She and some of their children went on to Abbyville, SC and descendants went from there to Monroe Co., Miss. and from there on to FAlls Co., TX. The Richard Duty mentioned in the Pulliam court case over the Robert and Rosanna Pinson Swanzy Estate was married to Sarah “Sallie” Pinson, daughter of “Cross Hill” John Pinson. The Howard and Thomas Pinson mentioned as bidders were sons of “Cross Hill” John. “Cross Hill” John Pinson was one of the sons of Lunenburg Aaron Pinson (died 1758) who is believed to be the uncle of Reverend Aaron Pinson.

Reverend Aaron Pinson and his probable brother Joseph moved to Laurens S.C. well before the Revolution. By 1790, elements of the Lunenburg Pinsons, including “Cross Hill” John had joined them. That makes things real confusing. There were 3 or 4 John Pinson families in 1790 Laurens. “Cross Hill” John is apparently the one by Richard Duty on pg 71 of the 1790 census.

Cross Hill John’s family was heavily intermarried into the Puckett clan. If I remember right, 3 or 4 of his children married Pucketts. Apparently a brother of those Puckett’s married a Dabney lady. Was Dabney Puckett who purchased Rosanna Swanzy’s ferry a product of that union? I don’t know—my knowledge of the Lunenburg line is fleeting. I descend from the Reverend Aaron, so I quickly forget the minutia surrounding the other line.

However, your Swanzy Pinsons are all tangled up with the Cross Hill John Pinsons.
