Arrington Wills and Probates:

What you must understand: when people wrote wills, and it was usually the male head of household who was in a position to do that, they wrote them, signed them, and three neighbors sign them.  But the wills were not active till registered with the county, which usually happened after the death.  Then the will had to be proved, the witnesses examined – and character witness for the witnesses.

The will is then read.  But applying it isn’t always easy. If there are any complications at all, it goes into probate. Quite often, the father leaves the mother a life interest in his property – but only as long as she remains a widow. If she dies or marries, then the children/heirs get to request a writ of partition – written up to look like an adversarial lawsuit – in order to get their legacies.  Then, if the children are young, there have to be guardianships set up for the management of property and funds as long as they are minors.

It can take YEARS between the date of a will and its registration and further years between the registration and the actual end of probate. It can take a decade or longer.

The person in charge of an estate that is defined by a will is an executor, if male, and executrix if female.  A person who is elected to be in charge of an estate that is “intestate,” meaning there was no will, is called an administrator.

In the name of god Amen, I William Arrington, being very sick and weak but of perfect mind and memory, thanks be given to Almighty God hoping through the merits, death and passion of my saviour Jesus Christ to have free pardon of all my sins and inherit everlasting life, and my body I commit to the ground to be buried decently by me executors hereafter named.

Item. I give unto my loving son Arthur Arrington the plantation whereon I now live and all the land belonging to the said plantation being two hundred forty acres to him my said son and to his heirs lawfully begotten of his body forever, and if my said son should die having no such issue, the said land and plantation to return to my son William Arrington and to the heirs of his body lawfully begotten forever.

Imprimis: I give unto my loving son John Arrington the plantation whereon he now lives and the one half of the land belonging to it, and after my said son John’s decease, I give the said land and plantation unto my grandson William Arrington and to his heirs forever. I give unto my son John forty shillings current money.

Imprimis: I give unto my loving son Benjamin Arrington the other remaining half of the said tract, dividend or parcel of land which is joining to my son John’s, to him my said son and his heirs forever, his brother John helping him to clear six thousand cow hills on the said land and to assist him to build a dwelling house twenty-five feet long and sixteen feet wide.

I give unto my daughter Mary Sykes two ewes and lambs and one cow and calf.

I give unto my daughter Elizabeth Crumpler one cow.

Item. I give unto my daughter Sarah Riggan one cow.

Imprimis: I give unto my daughter Ann Arrington six head of cattle, three of the said cattle being already under her mash. I give to my said daughter Ann one new feather bed with all the furniture thereunto belonging, two pewter dishes, one dozen of pewter spoons and a chest and one young mare.

Item. I give unto my granddaughter Ann Riggan one cow and calf, two pewter dishes, one basin.

Imprimis: I give unto my son Benjamin Arrington two cows and calves and two heifers of two year old, one horse that is called his, one feather bed and furniture now belonging to it which he lies on himself.

Item. I give unto my son Arthur one feather bed and furniture belonging to it, two cows and calves, two heifers of two year and a horse or mare, when he comes to the age of sixteen years.

And all the rest of my estate I give unto my dear and loving wife Elizabeth Arrington during her natural life or widowhood, and that my negro John labour and be unto my wife during her natural life or widowhood and at her death or marriage to be delivered to my son Benjamin Arrington, and also at her death or marriage all the rest of my estate be equally divided amongst all my children.

Upon second thought, I give and bequeath unto my son William Arrington my horse, arms, and rapier, a cow and five pounds current money.

I do appoint my loving wife Elizabeth Arrington and two of my sons John and Benjamin my whole and sole executors of this my last will and testament, revoking and making void all other wills heretofore made by me.

In witness whereof I have hereunto put my hand and seal to this my last will and testament being contained in half a sheet of paper this 4th day of May, 1725.

To my beloved wife Mary a negro woman called old Sary, furniture one huntin saddle and some cattle (summation because it’s late)

Lend the use of plantation and all lands to beloved wife during life or widowhood. At her death or day of marriage I give the same to be equally divided between my three sons namely Henry, Richard and Arthur. But in case my wife should dye or marry before my son Arthur is 21, land rented out. And money split between three sons. If they should die before 21 with no lawful issue, then give the same to surviror or survivors of them

In the name of God Amen. I, James Arrington of Warren County, and State of North Carolina being of sound and perfect mind (blessed be God) . . . As make and publish this my last will and testament in manner following, that is to say: First I give and bequeath unto each of my two Daughters Elizabeth Marshall and Martha Smith four hundred and twenty dollars to be raised of my Estate by Selling such of my property on a credit of six months as my wife shall choose to spare.

I lend all the rest of my Estate both real and persona after paying my just debts and the above mentioned legacy to my beloved wife, Ann Arrington for and during her life and at her death to be all sold on a credit of twelve months by my Execs and fir pay unto each of my four Daughters, Mary Southall, Elizabeth Marshall, Nancy Culpepper, and Martha Smith one hundred and eighty dollars and to my son Willis Arrington one hundred dollars and the remainder of my Estate to be equally divided between all my seven children namely Willis, James and Henry Arrington, Nancy Southall, Elizabeth Marshall Nancy Culpepper and Martha Smith, Except the on third part coming by the last mentioned clause to my daughter Martha Smith I give and bequeath to Mary Ann J Blount, daughter of Joseph Blount dec if she live to the age of twenty one years or Mary, if not to her Mother Martha Smith and I hereby make and  — my three sons, Willis, James and Henry Arrington my execs of this my last Will and Testament – 21 December 1807

Willis Arrington. Henry Southall, Edward Smith, James Arrington (large bible 1 jug), Anthony Arrington  ( a bone knife).  Medicus Robertson? (counterpane and sheet). William Collins, 1 blanket, piece of leather 

(WHO IS ANTHONY?) – I have not found ANY Anthony Arrington but the one who is Joseph (son of Arthur) Arrington’s son, who was living in Greene County in the mid 1820s. If this is that person, this is proof that this branch of the family was intimately acquainted with the Halifax branch.  This would make perfect sense, of course, as Arthur Jr. and James Thomas were brothers.   And Arthur had Arthur and Joseph, while James Thomas had  James jr. So they were cousins.  Which meant that the Arthur whose children lived in Greene and Anthony who lived in Greene and John D and Nicholas who lived in Greene, were – if my mind is still intact – second cousins.  So Ann would be leaving the bone knife to her grand nephew, her grandsons’ second cousin.

  • Page 31, McDonald and Samuel Davis were also bond for Thomas Jackson.  So do Sam and James just hang around bonding for everybody? If so, then it’s not that significant that Samuel’s daughter married Nicholas.

3. JOHN FLOYD ABIAS3 PORTIS (GEORGE2, JOHN1) was born 1740, and died June 1794 in Nash Co., NC. He married SARAH JANE WILDER 1755 in Isle of Wight, VA.

Notes for JOHN FLOYD ABIAS PORTIS:

John Portis died at his residence on Fishing Creek near Ransom’s Bridge and near the intersection of Halifax, Franklin, Warren, and Nash Counties. The property was also known as the “Portis Gold Mines”. His antecedent ancestors in America reportedly originated in Isle of Wight and Surry Counties, VA (not yet confirmed). John Portis left a will which his widow Sarah, and a number of other legatees mutually agreed to suppress. However, his “minor” son, Ira Portis, “by his guardian” brought suit in the Halifax Superior Court to a) establish the will of his father, and b) recover the legacy left to him by his father. (Halifax Superior Court Docket. (“Suppressed Will of John Portis-1794-of Nash County, NC,” North Carolina Genealogical Society Journal, Vol. IV, No. 3, August 1978, pp. 169-170). The will identifies his children and some aspects of their status as of 5 May 1800.

His name is associated with William Murphy 1832.  Pd May 10 1832 to S.S Arrington for boarding James Arrington signed Anthony L Arrington. 1833 T Snedicore Boarding John P at the residence of Wm M Murphy. Elizabeth Matthews is some kind of gdn.. Willis Arrington  present gdn of James Arrington to Archibald Mathews and his wife, Elizabeth Matthews, formerly Elizabeth Wilcox by virtue of her gdnship before marriage to boarding said minor, wishing lodging, making clothes and mending 25 Nov 1833 till 27 August 1834. Inge to James Battle For boarding Mariah Arrington 6 months. To Anthony S, for boarding Arthur Arrington. (James R Battle is the husband of Elizabeth Wright Arrington – Boddie, pg 4)

i25/80 final settlement but only half of it, the half with the name on it.  Account names that include A.S> Arrington and Snedicor, but I don’t recognize any of the others yet. Look up R. Inge – Dr. Richard Inge.

This file is indicated as probate of John “T” Arrington. But it’s actually John D.

i15 Robert is alive in 1849

i72 H Kennen  Miss  Arrington to HJ Kennon – recd of EJDavis in full.  Mary Arrington?

i77 Elizabeth J Davis  – James C Bizzell  Wm Bizzell securities

i108 Mr. Geo C Arrington gdn for MAE Arrington.  Mentions Shumate, Sims i111 Recept  Miss Bettie Arrington – bought of G.C. Arrington dealer in Dry Goods, Groceries, Hardware, Boots and Shoes. I115 mentions George, MAE and PC Shumate – with Simms.  I118 Forkland Feb 24 1876.  THIS DOC makes the statement that MAE Arrington is now MAE Latimer., and Charles E Latimer signs it.  So this is solid proof.

I125 Sam G Briggs i141 mentions Miss E T Davis for clothes etc.

Wait  – how old was George C Arrington, that his name would be on a letterhead?  I142 Nov 1857 it mentions tuition for George.

I146 = there’s the letterhead again, but now it’s Arrington and Perry for Bettie (MAE) Arrington 1873

I156 Mr. J T Arrington for one course of singing lessons. Payment of EJ Davis to B Round feb 53

Other small notes follow 1851-53, interesting. On one receipt, it is noted that the Irish linen is for John’s mother.

I166 – a receipt for Lovet Hines for Miss Arrington 1850

All through but found on 169 – the name J.H. Caldwell and S.W. Caldwell. I think they are merchants, and now I am wondering if they are relatives of Edmund who married Turner’s sister Nancy.

I183 – Ej Davis, William H Bizzell, and James C? Bizzell bond making Elizabeth gdn of the minor children including Martha Ann Arrington, James P  – minor heirs of father John D Arrington

I185  George C Arrington is gdn in 1875  – so this is for MAE

Also She is gdn of George C Arrington, also John T Arrington.  Her name is written Elizabeth J Arrington, then the surname is struck out and Davis superimposed.  She is a double widow by this time.  J.H. Caldwell on list of accounts. A number of names.

Pg 315: gdn James Arrington.  In this account, there is a William Webb mentioned for something in 1851.  But that’s a Sneed research name. There is also a J Holbrook here.  Could that have any connection to Turner Davis’ Holbrook in-laws in Sumter?

Also gdn of Martha Arrington. In i317 – Hines, Kennon, McAlpin, Holbrook, Clement, Brassfied – Jacob Holbrook not our family, but Jacob Bowden.

7. James H Caldwell, acting justice of peace.  Martha Ann Arrington a minor of 14 years April 22nd 1847, requesting Mom as gdn. James Portis Arrington Appear selected his mother, Mrs. Davis, for gdn 24th April 1847

11. Martha’s request for her mother as gdn. 27 Sept 1847 Martha is stated as ABOVE the age of 14. If I got that wrong before – was the last statement that year?? I was flying on auto pilot.

https://familysearch.org/pal:/MM9.3.1/TH-1942-23304-29261-21?cc=1978117&wc=MX52-HZ9:314241801,314484201 This is a file indicated as Henry J Arrington – but it’s H T’s estate.  There is another file that I really wanted to read, but it has another person’s docs in it.  This one  – i8, includes a doc from Bettie Arrington to Mr. M D Garrett 1866 its about tuition.  Wait, this is about Nicholas  Arrington’s estate.  Bettie is someone for whom the estate is paying tuition.  This would be Mary A E – who goes by Elizabeth and Bettie both in the census as the decades go on.

i69 – looks like MAE boarded with Betsy Jane Travis (Elizabeth J Cherry Arrington Davis Travis).

i72 – Alabama Central F. College Oc 20, 1868 Recv of Mrs. C Arrington 60$ on account of daughter’s expenses for academic year.   These were folks with money – especially M A Elizabeth was –
